                                         PRE-INSPECTION AGREEMENT

  BlueFox Services and/or any individuals representing the BlueFox Home Inspection Service “name” or “Label” agree to conduct an inspection for the purpose of informing “Client “ of major deficiencies or defects and the overall condition of the said property. The inspection and a corresponding generated inspection report are performed and prepared for the sole, confidential and exclusive use and possession of the Client. The written inspection report will attempt to entail but may not be obligated to include the following property areas: structural condition and basement ; electrical, plumbing, water heater, heating and cooling; quality ,condition and life expectancy of major systems; kitchen and appliances; general interior, ceilings, walls, windows, insulation, ventilation; general exterior, roof, gutter, chimney, and drainage.  Condominium inspections will be limited only to the interior of the inspected condominium unit.  Any other areas outside of the condominium unit are not included in this inspection. Such condo areas may include : condominium building structure, flooring structures, parking garage structure, interior condominium hallways, roofing structures, electrical supply systems, balconies, mold, asbestos, fire/sprinkler systems, elevator systems, pools, marina, Heating/Air Supply systems, or presence of termite/rodents/insects .

  It is understood and agreed by “client” that this inspection will be limited to readily accessible areas of the property, building ,or residential unit and is limited to the visual observations of apparent conditions existing only at the time of the inspection. Latent and concealed defects, deficiencies, errors, are excluded from the inspection; equipment, items, and systems will not be dismantled. Maintenance  and other items may be discussed orally during inspection, but they are not part of the inspection. The report is not a licensed engineering review, compliance inspection or certification for past or present governmental codes or regulations of any kind. The inspection and report do not address and are not intended to address the possible presence of or danger from any potentially harmful substances and environmental hazards, including but not limited to randon gas, lead paint, asbestos, mold, mildew, urea formaldehyde, toxic or flammable chemicals, and water and airborne hazards. A specialist should be consulted if a danger is suspected. Also excluded from this inspection are swimming pools, wells, septic systems, security systems, central vacuum systems, water softners, sprinkler systems, fire and safety equipment, and the presence or absence of rodents, termites, and other insects.

The parties agree that BlueFox Services , it’s independent agents , employees, or any independent inspector representing the BlueFox “name” or “label” , assume absolutely no liability or responsibility for the cost of repairing or replacing any unreported defect or deficiency, either current or arising in the future, or for any damage, consequential damage or bodily injury of any nature. THE INSPECTION AND REPORT ARE NOT INTENEDED OR TO BE USED AS A GUARANTEE OR WARRANTY,EXPRESSED OR IMPLIED,REGARDING ADEQUACY,PERFORMANCE OR CONDITION OF ANY INSPECTED STRUCTURE , ITEM OF COMPANY IS NOT AN INSURER OF ANY INSPECTED CONDITIONS.  Client acknowledges that they are purchasing inspected property and are analyzing the submitted inspection report results from the purchased “on-site inspection” solely at their own risk and discretion.                      

It is understood and agreed that should BlueFox Services and/or any of its agents, employees or any individuals inspecting under the BlueFox Home Inspection “name” or “label” , be found liable for any loss or damage resulting from a failure to perform any of its obligations, including but not limited to negligence breach of contract, or otherwise, then the liability shall be limited to the amount of the fee paid by the Client for the inspection and report.

 Client agrees that should a court of competent jurisdiction determine and declare that any portion of this agreement is void, voidable or unenforceable, the remaining provisions and portions shall remain in full force and effect. Acceptance and understanding of this agreement are hereby acknowledged. Client agrees and is liable for all court and attorney costs that incur during any legal proceedings regardless of verdict or court direction to  BlueFox Services and/or any of its independent agents, employees or any individuals inspecting under the BlueFox Home Inspection “name” or “label”.

 Payment: … Payment in full is due at the end of the inspection. The Inspection Report will not be generated nor submitted to “client : or “client representative” if payment is not received at the end of the inspection. If payment is received by check and check “bounces” due to any circumstances, client will be charged  an additional $25.00 for the default.  If payment is in default, Costs of “inspection” and a $25.00 default charge will be due immediately. If new requested payment is not received within 3 business days, client will be held responsible and liable for all  fees including  attorney and collection fees required/due as a result of collecting payment from client.
